UNITED STATES – Immigration Proposals from the White House and Congress that Could Impact Businesses and Workers

The White House recently issued an Executive Order which limits the entry of certain individuals into the United States, and updates to this Executive Order are being released on an almost daily basis.  As the “travel ban” issues continue to be discussed, details of further proposed Executive Orders on business immigration have been leaked to the public.

Upon first review of the leaked draft Executive Orders, along with a few bills recently introduced in Congress, the proposals could have a major impact on the employment visa process, including temporary work authorisation and permanent resident status (green cards) for foreign national employees.

Our US immigration law partner, Maggio + Kattar, has prepared a summary of the contents of the leaked draft Executive Orders and the proposed congressional bills, and an analysis of their potential impact on businesses.

Action Items

  • Employers sponsoring foreign national workers in the US should expect changes to the immigration rules and possible adjudication delays in the coming months.
