BRAZIL – New Rules for Residence Renewal Published [UPDATED]
On 25 July 2018, the National Immigration Council published Normative Resolution 30/2018 regulating procedures for the renewal of residence authorisation for foreign professionals, effective immediately.
Normative Resolution 30 establishes that, after the initial two years validity expires, the Ministry of Labour may renew the period of residence authorisation for up to two years or change the term of residence to an indefinite period. The Ministry of Labour will make a decision on a residence renewal application within 30 days.
Among the documents that must be presented for a renewal application are a copy of the national Migration Card (in Portuguese, Carteira de Registro Nacional Migratório or CRNM) and a signed declaration that the applicant has no criminal record.
[UPDATE] The Ministry of Labour has published further clarification of the procedures for renewal of work and residence authorisation for those holding permits issued under the previous law.
According to the Ministry, holders of a work permit issued before 21 November 2017 who wish to extend their stay must first obtain a new residence permit under the latest Normative Resolutions. After holding this for two years, they will be able to apply to convert this to indefinite residence.
