MEXICO: Reminder of Annual Corporate File Update Requirement

Every year in March and April, upon completing the annual tax declaration, companies legally established in Mexico and registered with the National Immigration Institute (INM) as employers of foreign workers are required to update their file of corporate documentation (Constancia de Inscripción de Empleador).

The purpose of this update process is to notify the immigration authority of any changes in the past year related to the company’s legal name, address, subsidiaries, legal representatives or annual tax report.

It takes about four to eight weeks to complete the update procedure, during which time a verification visit by INM officers may take place. Failure to comply with the visit or other requirements may result in the denial of the file update; in this case, a new file update procedure will need to be initiated.

Note that while the update is being processed by the INM, all the company’s immigration applications will be affected until the updated version of the file is issued.
